Welcome to Uncharted. These Terms of Service ("Terms") govern your access to and use of our platform, which includes questing features and a launchpad ("Services"). Please read these Terms carefully before using our Services. By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

   1. By accessing or using our Services, you agree to these Terms. If you do not agree to these Terms, you may not access or use our Services.

2. Use of Services

   1. You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to use our Services:

      • In any way that violates any applicable law or regulation.

      • To engage in any fraudulent activity or to impersonate any person or entity.

      • To infringe upon the rights of others, including intellectual property rights.

3. Questing

   1. Our platform offers questing in the form of missions where users can participate in, and complete missions. Users may earn Rewards for completing quests, which may include points, virtual currency, digital goods, or other incentives. Rewards do not function as financial instruments and are not attributed to the financial market. Rewards are not financial instruments and are not being offered to investors. Rewards may reside solely within the underlying distributed-ledger network and may or may not have value. You acknowledge that rewards are granted by the developers or publishers of the respective Games and that we are neither responsible nor control the granting or issuance of any Game rewards.

4. Launchpad

   1. Our platform includes a launchpad feature where users may participate in Non-fungible token (NFT offerings), including auctions and sales.

5. User Accounts

   1. In order to access certain features of our Services, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

   2. Uncharted does not store any wallet credentials. We do not receive or store your wallet password, or its private keys. We cannot assist you with password or private key retrievals. You are solely responsible for remembering, storing and keeping secret your password and private keys. Any NFT or digital asset that you have stored within a supported web3 third-party wallet may become inaccessible if you do not know or keep secret its private keys and password.

   3. Additionally, we use third party applications such as Privy.io to facilitate the creation of accounts or minting of NFTs. You may wish to refer to their terms and services. 

6. Asset Ownership

   1. All assets acquired via the Uncharted platform are under the user’s control. 

   2. Uncharted has no control over any NFTs or other digital assets in your wallet and cannot ensure that any transaction details a user submits via its wallet will be confirmed and processed on the underlying distributed ledger network. We cannot cancel, refund, or modify any transaction that you have submitted to the underlying distributed-ledger network.

7. Fees and Commissions

   1. Uncharted may charge fees or commissions for certain transactions conducted through our platform, including the sale of NFTs. The applicable fees and commissions will be clearly communicated to users prior to completing a transaction.

8. Intellectual Property

   1. All content included on our platform, such as text, graphics, logos, images, audio clips, video, data, software, and other material, is owned or licensed by Uncharted and is protected by copyright, trademark, and other intellectual property laws.

9. Limitation of Liability

   1. To the fullest extent permitted by law, Uncharted (BVI) limited shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in any way related to your use of our Services.

10. Changes to Terms

    1. Uncharted reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our Services after changes are posted constitutes your acceptance of the revised Terms.

11. Governing Law

    1. These Terms shall be governed by and construed in accordance with the laws of the British Virgin Islands, without regard to its conflict of law principles.
